Nitekim \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilerin bedensel ve ruhsal y\u00f6nden geli\u015fme \u00e7a\u011f\u0131nda olmalar\u0131 g\u00f6zetilerek, \u00e7al\u0131\u015fma ya\u015fam\u0131n\u0131n, bu geli\u015fmeyi engellememesini ama\u00e7 edinen yasal d\u00fczenlemeler getirilmi\u015f ve i\u015f mevzuat\u0131m\u0131zda \u00e7ocuk ve gen\u00e7 i\u015f\u00e7iler i\u00e7in baz\u0131 \u00f6zel koruyucu h\u00fck\u00fcmlere yer verilmi\u015ftir.<br \/>\n\u0130\u015f bu koruyucu yasal d\u00fczenlemelerin temelini olu\u015fturan Anayasa\u2019n\u0131n 50. maddesi ile \u201cKimse, ya\u015f\u0131na, cinsiyetine ve g\u00fcc\u00fcne uygun olmayan i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131lamaz. K\u00fc\u00e7\u00fckler ve kad\u0131nlar ile bedeni ve ruhi yetersizli\u011fi olanlar \u00e7al\u0131\u015fma \u015fartlar\u0131 bak\u0131m\u0131ndan \u00f6zel olarak korunurlar.\u201d denilmekle Anayasal g\u00fcvenceye kavu\u015fturulan \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilirin \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 s\u0131ras\u0131nda; herhangi bir i\u015fyerinde \u00e7ocuk ve gen\u00e7 i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131l\u0131p \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131, bu i\u015f\u00e7ilerin hangi esaslara g\u00f6re \u00e7al\u0131\u015ft\u0131r\u0131laca\u011f\u0131, d\u00fczenlenmesi gereken belgeler, verilmesi gereken e\u011fitimler, 4857 Say\u0131l\u0131 \u0130\u015f Kanunu ve \u201c\u00c7ocuk ve Gen\u00e7<\/p>\n<p>\u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d ile a\u00e7\u0131klanmaktad\u0131r;<br \/>\n<strong>1-\u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7i Tan\u0131mlar\u0131;<\/strong><br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7i kavramlar\u0131, \u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik\u2019in 4. maddesinde tan\u0131mlanm\u0131\u015ft\u0131r. Buna g\u00f6re;<br \/>\n&#8211; Gen\u00e7 i\u015f\u00e7i, 15 ya\u015f\u0131n\u0131 tamamlam\u0131\u015f, ancak 18 ya\u015f\u0131n\u0131 tamamlamam\u0131\u015f,<br \/>\n&#8211; \u00c7ocuk i\u015f\u00e7i ise 14 ya\u015f\u0131n\u0131 bitirmi\u015f, 15 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f ve ilk\u00f6\u011fretimini tamamlam\u0131\u015f ki\u015fiyi ifade etmektedir.<br \/>\n<strong>2-\u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Esaslar\u0131;<\/strong><br \/>\n<strong>a) Yaz\u0131l\u0131 \u0130\u015f S\u00f6zle\u015fmesi Akdedilme Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc;<\/strong><br \/>\n\u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik 12. maddesi uyar\u0131nca; i\u015fverenler, \u00e7ocuk veya gen\u00e7 i\u015f\u00e7ilerin velisi veyla vasisi ile yaz\u0131l\u0131 i\u015f s\u00f6zle\u015fmesi yapmak zorundad\u0131rlar.<br \/>\nAyr\u0131ca i\u015fverenler taraf\u0131ndan; \u00e7ocuk ve gen\u00e7 i\u015f\u00e7inin velisi veya vasisine, \u00e7ocuk ve gen\u00e7 i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131r\u0131laca\u011f\u0131 i\u015f, kar\u015f\u0131la\u015fabilece\u011fi riskler ve al\u0131nan \u00f6nlemler hakk\u0131nda bilgi verilmeli, okula devam eden \u00e7ocuk ve gen\u00e7 i\u015f\u00e7iden \u00e7al\u0131\u015ft\u0131rmaya ba\u015flamadan \u00f6nce, \u00f6\u011frenci oldu\u011funa dair belge istenerek, bu belge \u00f6zl\u00fck dosyas\u0131nda muhafaza edilmelidir.<br \/>\n<strong>b)\u00c7al\u0131\u015ft\u0131rma Ya\u015f\u0131 ve Yasaklar\u0131;<\/strong><br \/>\nHukukumuzda en az \u00e7al\u0131\u015fma ya\u015f\u0131 4857 Say\u0131l\u0131 \u0130\u015f Kanunu 71.maddesinde d\u00fczenlenmi\u015ftir. An\u0131lan madde uyar\u0131nca; 15 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuklar\u0131n \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 yasakt\u0131r. Ancak, on d\u00f6rt ya\u015f\u0131n\u0131<br \/>\ndoldurmu\u015f ve zorunlu ilk\u00f6\u011fretim \u00e7a\u011f\u0131n\u0131 tamamlam\u0131\u015f olan \u00e7ocuklar; bedensel, zihinsel, sosyal ve ahlaki geli\u015fmelerine ve e\u011fitime devam edenlerin okullar\u0131na devam\u0131na engel olmayacak hafif i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131labilirler. On d\u00f6rt ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuklar ise bedensel, zihinsel, sosyal ve ahlaki geli\u015fmelerine ve e\u011fitime devam edenlerin okullar\u0131na devam\u0131na engel olmayacak sanat, k\u00fclt\u00fcr ve reklam faaliyetlerinde yaz\u0131l\u0131 s\u00f6zle\u015fme yapmak ve her bir faaliyet i\u00e7in ayr\u0131 izin almak \u015fart\u0131yla \u00e7al\u0131\u015ft\u0131r\u0131labilirler.<br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7ilerin i\u015fe yerle\u015ftirilmelerinde ve \u00e7al\u0131\u015ft\u0131r\u0131labilecekleri i\u015flerde g\u00fcvenlik, sa\u011fl\u0131k, bedensel, zihinsel ve psikolojik geli\u015fmeleri, ki\u015fisel yatk\u0131nl\u0131k ve yetenekleri dikkate al\u0131n\u0131r. \u00c7ocu\u011fun g\u00f6rd\u00fc\u011f\u00fc i\u015f onun okula gitmesine, mesleki e\u011fitiminin devam\u0131na engel olamaz, onun derslerini d\u00fczenli bir \u015fekilde izlemesine zarar vermemelidir.<br \/>\n4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 72. maddesi uyar\u0131nca; maden ocaklar\u0131 ile kablo d\u00f6\u015femesi, kanalizasyon ve t\u00fcnel in\u015faat\u0131 gibi yer alt\u0131nda veya su alt\u0131nda \u00e7al\u0131\u015f\u0131lacak i\u015flerde, 18 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f erkek ve her ya\u015ftaki kad\u0131nlar\u0131n \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 yasakt\u0131r. Getirilen yasak, h\u00fck\u00fcmde \u00f6rnek olarak say\u0131lan i\u015flerle s\u0131n\u0131rl\u0131 de\u011fildir, yer alt\u0131nda ve su alt\u0131nda yap\u0131lan b\u00fct\u00fcn i\u015fleri kapsamaktad\u0131r.<br \/>\n4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 73 \u00fcnc\u00fc maddesi uyar\u0131nca ise; sanayiye ait i\u015fyerlerinde, 18 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilerin gece \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 (gece d\u00f6nemine denk d\u00fc\u015fen 20.00-06.00 saatleri aras\u0131ndaki i\u015f\u00e7i postalar\u0131nda) yasakt\u0131r.<br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7inin i\u015fe yerle\u015ftirilmesinde ve \u00e7al\u0131\u015fmas\u0131 s\u00fcresince g\u00fcvenli\u011fi, sa\u011fl\u0131\u011f\u0131, bedensel, zihinsel, ahlaki ve psikososyal geli\u015fimi, ki\u015fisel yatk\u0131nl\u0131k ve yetenekleri dikkate al\u0131nmal\u0131d\u0131r. \u00c7ocuk ve gen\u00e7 i\u015f\u00e7iler, okula devam edenlerin okula devamlar\u0131 ile okuldaki ba\u015far\u0131lar\u0131na engel olmayacak, meslek se\u00e7imi i\u00e7in yap\u0131lacak haz\u0131rl\u0131klara ya da yetkili makamlar taraf\u0131ndan yeterlili\u011fi kabul edilen mesleki e\u011fitime kat\u0131lmas\u0131na engel olmayacak i\u015flerde \u00e7al\u0131\u015ft\u0131r\u0131labilirler. \u0130\u015fverenler \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilerin tecr\u00fcbe eksikli\u011fi, mevcut veya muhtemel riskler konular\u0131nda bilgisizlik veya tamamen geli\u015fmi\u015f olmamalar\u0131na ba\u011fl\u0131 olarak geli\u015fmelerini, sa\u011fl\u0131k ve g\u00fcvenliklerini tehlikeye sokabilecek herhangi bir riske kar\u015f\u0131 korunmalar\u0131n\u0131 temin etmekle y\u00fck\u00fcml\u00fcd\u00fcrler.<br \/>\n\u00c7ocuk i\u015f\u00e7ilerin \u00e7al\u0131\u015fmas\u0131na izin verilen hafif i\u015fler, gen\u00e7 i\u015f\u00e7ilerin \u00e7al\u0131\u015fmas\u0131na izin verilen i\u015fler ve 18 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuk ve gen\u00e7 i\u015f\u00e7iler bak\u0131m\u0131ndan yasak olan i\u015fler \u201c\u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d ile d\u00fczenlenmi\u015f olup, bu i\u015fler bilgi notumuzun son k\u0131sm\u0131nda ayr\u0131nt\u0131l\u0131 olarak bilgilerinize sunulmu\u015ftur.<br \/>\n<strong>c) \u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma S\u00fcreleri;<\/strong><br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7ilerin sa\u011fl\u0131\u011f\u0131n\u0131 korumak amac\u0131yla di\u011fer i\u015f\u00e7ilerden farkl\u0131 bi\u00e7imde k\u0131salt\u0131lm\u0131\u015f i\u015f s\u00fcreleri getirilmi\u015f olup bu s\u00fcreler 4857 Say\u0131l\u0131 i\u015f Kanunu 71. madde ve \u201c\u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131lma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik\u201d 6.maddesi ile d\u00fczenlenmi\u015ftir. Buna g\u00f6re;<br \/>\n\u2014 Temel e\u011fitimini tamamlam\u0131\u015f ve okula gitmeyen \u00e7ocuklar\u0131n \u00e7al\u0131\u015fma saatleri g\u00fcnde yedi ve haftada otuz be\u015f saatten fazla olamaz. Ancak, 15 ya\u015f\u0131n\u0131 tamamlam\u0131\u015f \u00e7ocuklar i\u00e7in bu s\u00fcre g\u00fcnde sekiz ve haftada k\u0131rk saate kadar artt\u0131r\u0131labilir.<br \/>\n\u2014 \u00c7ocuk ve gen\u00e7 i\u015f\u00e7ilerin g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcreleri, yirmi d\u00f6rt saatlik zaman diliminde, kesintisiz on d\u00f6rt saat dinlenme s\u00fcresi dikkate al\u0131narak uygulan\u0131r.<br \/>\n\u2014 Okula devam eden \u00e7ocuklar\u0131n e\u011fitim d\u00f6nemindeki \u00e7al\u0131\u015fma s\u00fcreleri, e\u011fitim saatleri d\u0131\u015f\u0131nda olmak \u00fczere, en fazla g\u00fcnde iki saat ve haftada on saat olabilir. Okulun kapal\u0131 oldu\u011fu d\u00f6nemlerde \u00e7al\u0131\u015fma s\u00fcreleri yukar\u0131da belirtti\u011fimiz esaslara g\u00f6re(ya\u015fa g\u00f6re haftal\u0131k 35 veya 40 saat) belirlenir.<br \/>\n\u2014 \u0130ki saatten fazla d\u00f6rt saatten az s\u00fcren i\u015flerde otuz dakika, d\u00f6rt saatten yedi bu\u00e7uk saate kadar olan i\u015flerde \u00e7al\u0131\u015fma s\u00fcresinin ortas\u0131nda bir saat olmak \u00fczere ara dinlenmesi verilmesi zorunludur.<br \/>\n<strong>d) \u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin Tatil ve Y\u0131ll\u0131k \u00dccretli \u0130zin S\u00fcreleri;<\/strong><br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7ilerin hafta tatili izinleri kesintisiz k\u0131rk saatten az olamaz ve ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015ft\u0131r\u0131lamazlar. Bu g\u00fcnlere ili\u015fkin \u00fccretleri ise bir i\u015f kar\u015f\u0131l\u0131\u011f\u0131 olmaks\u0131z\u0131n \u00f6denmelidir. (Y\u00f6n.8. ve 9. md.)<br \/>\nYine \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilere verilecek y\u0131ll\u0131k izin s\u00fcresi 20 g\u00fcnden az olmamal\u0131d\u0131r. Y\u0131ll\u0131k \u00fccretli iznin kesintisiz kulland\u0131r\u0131lmas\u0131 esast\u0131r. Ancak yarar\u0131na oldu\u011fu durumlarda \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilerin iste\u011fi \u00fczerine en fazla ikiye b\u00f6l\u00fcnerek kulland\u0131r\u0131labilir. (\u0130K 53\/5, Y\u00f6n.10.md.)<br \/>\nAyr\u0131ca yukar\u0131da a\u00e7\u0131klanan \u015fekli ile; 4857 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 71. maddesinde belirtilen \u00e7al\u0131\u015ft\u0131rma ya\u015f\u0131 ve \u00e7ocuklar\u0131 \u00e7al\u0131\u015ft\u0131rma yasa\u011f\u0131 h\u00fckm\u00fcne ayk\u0131r\u0131 hareket eden, 72. maddesi h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak yer alt\u0131nda ve su alt\u0131nda 18 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f erkek \u00e7ocuklar\u0131, gen\u00e7leri ve her ya\u015ftaki kad\u0131nlar\u0131 \u00e7al\u0131\u015ft\u0131ran, 73. maddesine ayk\u0131r\u0131 olarak \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ileri gece \u00e7al\u0131\u015ft\u0131ran i\u015fveren hakk\u0131nda ayn\u0131 yasan\u0131n 104. md. gere\u011fince idari para cezas\u0131 uygulanmaktad\u0131r.<br \/>\n<strong>e) Sair \u0130\u015fveren Bor\u00e7 ve Y\u00fck\u00fcml\u00fcl\u00fckleri;<\/strong><br \/>\n\u00c7ocuk ve gen\u00e7 i\u015f\u00e7ilere y\u00f6nelik olarak d\u00fczenlenen yasa h\u00fck\u00fcmlerinin bir arada de\u011ferlendirilmesi ile i\u015f\u00e7iler lehine ve yarar\u0131na olacak \u015fekilde farkl\u0131l\u0131klar\u0131n bulundu\u011fu a\u00e7\u0131kt\u0131r. Bu itibarla 4857 say\u0131l\u0131 Yasa kapsam\u0131nda d\u00fczenlenen ve t\u00fcm i\u015f\u00e7ilerin menfaatine olacak \u015fekilde, i\u015fverenlere kar\u015f\u0131 bir tak\u0131m y\u00fck\u00fcml\u00fcl\u00fckler getiren sair yasa h\u00fck\u00fcmlerinin, \u00e7ocuk ve gen\u00e7 i\u015f\u00e7iler y\u00f6n\u00fcnden de ba\u011flay\u0131c\u0131 olaca\u011f\u0131 tabiidir. Temel i\u015fveren bor\u00e7lar\u0131ndan say\u0131lan; \u00fccret \u00f6deme borcu, i\u015f\u00e7iyi g\u00f6zetme borcu, e\u015fit davranma ve di\u011fer i\u015fveren bor\u00e7lar\u0131, \u00e7ocuk ve gen\u00e7 i\u015f\u00e7iler y\u00f6n\u00fcnden de i\u015fveren a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131 olacakt\u0131r. \u00d6rne\u011fin; 18 ya\u015f\u0131ndan b\u00fcy\u00fck \u00e7al\u0131\u015fanlar\u0131n i\u015fyerine geli\u015f ve gidi\u015flerinde servis sa\u011flanmas\u0131na kar\u015f\u0131n, \u00e7ocuk ve gen\u00e7 i\u015f\u00e7ilerin herhangi bir objektif ve hakl\u0131 bir neden bulunmaks\u0131z\u0131n servisten faydaland\u0131r\u0131lmamalar\u0131 e\u015fitlik ilkesine ayk\u0131r\u0131l\u0131k olarak kabul edilecektir.<br \/>\n<strong>f) \u00c7ocuk ve Gen\u00e7 \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131labilecekleri \u0130\u015fler;<\/strong><br \/>\n\u00c7ocuk \u0130\u015f\u00e7ilerin \u00c7al\u0131\u015ft\u0131r\u0131labilecekleri Hafif \u0130\u015fler<br \/>\n1.
