uluslararas\u0131 ve ulusal mevzuat, temel veri koruma ilkeleri ve i\u00e7tihatlar y\u00f6n\u00fcnden irdelemektedir.<\/p>\n<p>Kurul, \u00e7al\u0131\u015fma s\u00fcrelerinin takibine ili\u015fkin mevzuatta, i\u015fverenlere bu amaca ula\u015fmak i\u00e7in biyometrik veri i\u015fleme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc veya zorunlulu\u011fu getirilmedi\u011fini, bu nedenle biyometrik veri kullan\u0131m\u0131n\u0131n ancak 6698 say\u0131l\u0131 Ki\u015fisel Verilerin Korunmas\u0131 Kanunu\u2019ndaki \u00f6zel \u015fartlar, \u00f6zel nitelikli ki\u015fisel verilerin i\u015flenmesine ili\u015fkin rehberler ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi g\u00f6zetilerek de\u011ferlendirilmesi gerekti\u011fine i\u015faret etmi\u015ftir.<\/p>\n<p>Bu kapsamda ilgi tutulan kararda;<\/p>\n<ul>\n<li>Biyometrik verilerin \u00f6zel nitelikli veri olmas\u0131 sebebiyle daha y\u00fcksek koruma gerektirdi\u011fi,<\/li>\n<li>Her ne kadar i\u015f mevzuat\u0131nda \u00e7al\u0131\u015fanlar\u0131n \u00e7al\u0131\u015fma s\u00fcrelerinin kay\u0131t alt\u0131na al\u0131nmas\u0131 h\u00fckme ba\u011flanm\u0131\u015f ise de, mesai takibi i\u00e7in biyometrik veri kullan\u0131m\u0131n\u0131 zorunlu k\u0131lan bir d\u00fczenleme bulunmad\u0131\u011f\u0131,<\/li>\n<li>Bu y\u00f6n\u00fcyle sadece \u00e7al\u0131\u015fma saatlerinin kaydedilmesi amac\u0131yla biyometrik veri i\u015flenmesinin hukuka ayk\u0131r\u0131l\u0131k te\u015fkil edebilece\u011fi,<\/li>\n<li>\u00d6zel nitelikli verilerin i\u015flenme ko\u015fullar\u0131n\u0131n 6698 say\u0131l\u0131 Yasa\u2019da s\u0131raland\u0131\u011f\u0131 ve fakat mesai takibi amac\u0131yla biyometrik verilerin i\u015flenmesine dair uygulamalar\u0131n Yasa\u2019n\u0131n 6\/3.maddesinde belirtilen di\u011fer \u00f6zel \u015fartlardan birine uymamas\u0131 sebebiyle yo\u011fun olarak \u201ca\u00e7\u0131k r\u0131za\u201d \u015fart\u0131na dayal\u0131 olarak ger\u00e7ekle\u015ftirildi\u011fi,<\/li>\n<li>Ancak i\u015f ili\u015fkilerinde taraflar aras\u0131nda g\u00fc\u00e7 dengesizli\u011fi bulundu\u011fu g\u00f6zetildi\u011finde, \u00e7al\u0131\u015fanlar\u0131n biyometrik verilerinin i\u015flenmesine dair verdikleri r\u0131zan\u0131n \u00f6zg\u00fcr iradeye dayand\u0131\u011f\u0131ndan s\u00f6z etmenin m\u00fcmk\u00fcn olmayaca\u011f\u0131, bilhassa \u00e7al\u0131\u015fan \u00fczerinde olu\u015fan bask\u0131n\u0131n, r\u0131zan\u0131n verilmemesi veya geri \u00e7ekilmesi halinde \u00e7al\u0131\u015fana bir alternatif sunulmamas\u0131n\u0131n, a\u00e7\u0131k r\u0131zan\u0131n ge\u00e7erlili\u011fini sorgulataca\u011f\u0131 ifade edilmi\u015ftir.<\/li>\n<li>Kararda ayr\u0131ca \u201c\u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi\u201d kapsam\u0131nda de\u011ferlendirme yap\u0131lm\u0131\u015f ve \u00e7al\u0131\u015fan\u0131n r\u0131zas\u0131 olsa dahi \u201cama\u00e7 ile veri i\u015fleme y\u00f6ntemi aras\u0131nda makul ba\u011flant\u0131 bulunup bulunmad\u0131\u011f\u0131\u201d, \u201cayn\u0131 sonuca daha az m\u00fcdahaleci y\u00f6ntemlerle ula\u015f\u0131l\u0131p ula\u015f\u0131lamayaca\u011f\u0131\u201d, \u201calternatif y\u00f6ntemlerin mevcut olup olmad\u0131\u011f\u0131\u201d, \u201cm\u00fcdahalenin gerekli ve orant\u0131l\u0131 olup olmad\u0131\u011f\u0131\u201d y\u00f6n\u00fcnden inceleme yap\u0131lmas\u0131 halinde i\u015flemenin hukuka ayk\u0131r\u0131 olaca\u011f\u0131 vurgulanm\u0131\u015ft\u0131r.<\/li>\n<li>Kararda mesai takibi i\u00e7in biyometrik sistemler yerine kullan\u0131labilecek\u00a0alternatif y\u00f6ntemlerede de\u011finilmi\u015f ve \u015fifre kart\u0131 sistemleri, PIN tabanl\u0131 giri\u015f sistemleri, imzal\u0131 puantaj \u00e7izelgeleri, RFID\/NFC kimlik kartlar\u0131, denet\u00e7i g\u00f6zetiminde elle giri\u015f-\u00e7\u0131k\u0131\u015f kay\u0131tlar\u0131 \u015feklinde somut \u00f6rneklendirmeler yap\u0131larak, bu gibi daha az m\u00fcdahaleci y\u00f6ntemlerin mevcudiyetinin biyometrik veri i\u015flemeyi \u00f6l\u00e7\u00fcs\u00fcz ve ama\u00e7s\u0131z k\u0131ld\u0131\u011f\u0131 ifade edilmi\u015ftir.<\/li>\n<\/ul>\n<p>Kurul de\u011ferlendirmelerini ayr\u0131ca Anayasa Mahkemesi ve Dan\u0131\u015ftay\u2019\u0131n biyometrik mesai takip sistemlerine mesafeli yakla\u015fan i\u00e7tihatlar\u0131 ile de desteklemi\u015ftir.<\/p>\n<p>Kurulun biyometrik veri i\u015fleme faaliyetlerine k\u0131s\u0131tlay\u0131c\u0131 yakla\u015ft\u0131\u011f\u0131 ve biyometrik veri ile mesai takibine olumsuz sonu\u00e7 ba\u011flayabildi\u011fi bilinen bir durum iken; gelinen noktada, \u00e7al\u0131\u015fanlar\u0131n i\u015fyerine giri\u015flerinin ve mesai takiplerinin parmak izi, y\u00fcz tan\u0131ma, iris\/retina taramas\u0131 gibi biyometrik sistemlerin kullan\u0131ld\u0131\u011f\u0131 uygulamalar ile ger\u00e7ekle\u015ftirilmesinin daha maruf \u015fekilde y\u00fcksek riskli hale geldi\u011fi de\u011ferlendirilmektedir.
